Understanding Probate in Victoria
When a person passes away, their Estate often requires Probate, a legal process confirming that the Will is valid and authorising the Executor to administer the Estate. At times, there may be no Will in existence. In this instance, Letters of Administration, a legal process similar to Probate, is required to administer the Estate.
A Grant of Probate or Letters of Administration is obtained from the Supreme Court of Victoria to prove the validity of the Will and enables the person named as Executor or Administrator to administer the Estate and distribute the Estate’s assets to the beneficiaries named in the Will.
